A judge refused to dismiss FOX' case against Warner Brothers for the rights to the Watchmen property. According to the suit, FOX retained the rights to the property back in 1994 but did not exercise them.
But spokespeople for Warner Brothers (unofficially) call the suit "opportunistic." They note that FOX sat on the option for years and even had a chance to renew, but passed.

I wanted to mention that I do not know the specifics of the case, but from a creator and industry standpoint, if FOX did not renew the option, they lost it. There is no case, if Warner Brothers can prove that single fact.
